Railroad Protective

Our Railroad Protective coverage will protect a railroad for acts or omissions arising from the work performed by a contractor working at a location on railroad property.  This coverage is job and location specific and is valid until the job is completed.

Coverage/Limits Available

  • General liability limits up to $1MM/$2MM
  • Both the “work” and “job location” are specifically designated on the policy
  • Contractor must carry a General Liability policy from an “A” rated carrier

Coverage Considerations

  • If your client is planning on working near or around a railway, a contract is required by the railroad due to the easements that are involved
  • The contract has an indemnification requirement that cannot be satisfied by the Commercial General Liability Policy if the operations are within 50 feet of railroad property
  • The Railroad Protective Liability Policy is the only method available to satisfy the indemnification requirements in a contract between a railroad and a contractor when operations are within 50 feet of railroad property and involve construction or demolition
  • The named insured on these policies is the railroad company (property owner)
  • The application will typically come from the contractor performing the construction as required by their contract, with either the railroad or municipality where the work is located
